Agreements database
23 May 2006: The National Native Title Tribunal has prepared a general guide for Local Government on content ideas for agreements
(PDF 430 kb) between Local Government and native title parties. The document is intended to provide triggers to assist parties in canvassing important issues during negotiations over agreements. The document includes a list of issues for consideration in drafting and negotiating agreements. While the list is not meant to be exhaustive, it is comprehensive in scope.
This document is a useful compendium to the ALGA's agreement guide that was published in 1999 and the Working with Native Title Guide also published in 1999.
Indigenous Land Use
ALGA has for some time been keen to provide some examples of agreements about native title matters between local government and Indigenous Australians. At this stage there are very few registered Indigenous Land Use Agreements (ILUAs) between local government and native title holders or claimants involving activities by local government. ILUAs also often contain provisions requiring the details of the agreement to be kept confidential.
However, to assist councils in identifying where agreements have been reached between local government and Indigenous Australians, there are two web based resources that can be searched for information. In most cases the information on these websites provide contact details of the parties involved, or we suggest you contact the council concerned if you want to find more details about the agreement or if you want to know about their experiences in developing the agreement and how they went about it.
The University of Melbourne, the Jumbunna House of Learning at the University of Technology Sydney and the (former) Aboriginal and Torres Strait Islander Commission (ATSIC), with the support of the Aboriginal and Torres Strait Islander Studies (AIATSIS), have developed a web-based database of agreements, treaties and negotiated settlement with Indigenous peoples in settler states.
Use the database's search function if you know the details of a particular agreement. Or use the browse function to locate agreements by: agreements, organisations, person, people(s), legislation, places, events, or concepts.
The National Native Title Tribunal (NNTT) website includes a list of the registered Indigenous Land Use Agreements as well as information about ILUAs generally.
